These Terms of Use govern your access to and use of the website at upstreamhomes.ca, including any content, features, forms, tools, and services made available on or through the website (collectively, the “Website”), operated by Canvergence Investment Solutions Inc., operating as Upstream Living (“Upstream,” “we,” “us,” or “our”). By accessing or using the Website, you agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you must not access or use the Website.

The Website provides general information about Upstream and our rent-to-own homeownership program (the “Program”). The Website is provided for informational and educational purposes only, and its content may be updated, corrected, removed, or changed at any time without notice.
3. Eligibility
You must be at least the age of majority in your province or territory of residence to use the Website or to express interest in the Program. By using the Website, you represent and confirm that you meet this requirement.
4. No advice and no offer
Nothing on the Website constitutes financial, legal, tax, mortgage, real estate, accounting, or investment advice, and nothing on the Website should be relied upon as a substitute for advice from qualified professionals. Nothing on the Website constitutes an offer to sell, a solicitation of an offer to buy, or an invitation to enter into any agreement, to buy or sell any property, to participate in the Program, or to invest in any opportunity. Any participation in the Program is subject to eligibility requirements, our review and approval, and the execution of separate written agreements. Please review our Disclaimer for further detail.
5. Program agreements govern
If you proceed with the Program, your rights and obligations will be set out in separate written agreements. In the event of any conflict or inconsistency between the Website, these Terms of Use, the Disclaimer, the Privacy Policy, and any such written agreements, the signed written agreements will govern to the extent of the conflict or inconsistency.

If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect. These Terms of Use, together with the Disclaimer and Privacy Policy, constitute the entire agreement between you and Upstream regarding your use of the Website. No waiver of any provision of these Terms of Use will be effective unless made in writing by Upstream, and no failure or delay in exercising any right will operate as a waiver.
